Withdrawal of a driver’s license is equivalent to a driving ban.

Within 8 days of the withdrawal (Saturdays, Sundays and public holidays are not included), you will be notified of a temporary driving ban order issued by the examining magistrate. This order conditions the withdrawal of the license.

On the basis of the examining magistrate’s order, you can ask for the provisional driving ban to be lifted. This request must be made in writing and filed with the clerk of the relevant court*, or sent by post. You’ll need to enclose various documents to support your need for a driver’s license.
*If you have received a summons to appear as an accused person, you may appear before the court to which you have been summoned.

If the application to lift the provisional driving ban is accepted, you will have to apply to the Société Nationale de Circulation Automobile (SNCA) for a new license. That said, the court may very well grant you a partial waiver of the driving ban, the example of business trips being the most common.

If the application for release is rejected, the provisional driving ban is extended, subject to appeal or a new application, until a decision on the merits is handed down by the competent criminal court.

Before the trial judge (magistrate’s court or police court), the offences with which you are charged are listed, and the court hands down a judgement which may include one or more driving bans. If a final driving ban has been imposed, the terms and conditions for enforcing the ban are determined by the Public Prosecutor’s Office and notified to the defendant by the police.

The judge may also exclude certain journeys from the ban, such as journeys made in the proven interest of the profession, journeys to and from the main residence and the second home, or any place considered to be habitual for family or professional reasons.

Le retrait du permis de conduire vaut interdiction de conduire.

Dans les 8 jours à compter du retrait (les samedis, dimanches et jours fériés ne sont pas inclus), une ordonnance prononçant l’interdiction de conduire provisoire du juge d’instruction vous sera notifiée. Cette ordonnance conditionne le retrait du permis.

Sur base de l’ordonnance du juge d’instruction, vous pouvez demander la main levée de l’interdiction de conduite provisoire. Cette requête doit se présenter sous forme écrite et doit être déposée auprès du greffier de la juridiction concernée*, sinon envoyée par courrier. Vous devrez annexer à cette requête divers documents justifiant la nécessité de disposer de votre permis de conduire.
*Chambre du conseil du tribunal d’arrondissement compétent ou, si vous avez réceptionné une citation à prévenu, devant la juridiction devant laquelle vous êtes cité.

Si la demande en mainlevée de l’interdiction de conduire provisoire est acceptée, vous devrez vous adresser à la Société Nationale de circulation automobile (SNCA) pour la délivrance d’un nouveau permis. Ceci dit, la juridiction peut très bien vous accorder une main levée partielle de l’interdiction de conduire, l’exemple des trajets professionnels étant le plus courant.

Si la demande en mainlevée est rejetée, dans ce cas l’interdiction de conduire provisoire est prolongée, sous réserve d’un appel ou d’une nouvelle demande, jusqu’à la décision prononcée au fond par le tribunal répressif compétent.

Devant le juge de fond (tribunal correctionnel ou tribunal de police) il est fait tableau des infractions qui vous sont reprochées et le Tribunal rend un jugement qui peut comporter une ou plusieurs condamnations à des interdictions de conduire. Si une condamnation définitive à une interdiction de conduire a été formulée, les modalités d’exécution de cette interdiction sont fixées par le Parquet général et notifiées au prévenu par la Police.

Le juge peut également exclure certains trajets de l’interdiction tels que les trajets effectués dans l’intérêt prouvé de la profession, les trajets d’allers-retours entre la résidence principale et la résidence secondaire ou tout lieu considéré comme habituel pour des motifs d’ordre familial ou professionnel.
