
{"id":2813,"date":"2020-05-13T19:50:51","date_gmt":"2020-05-13T18:50:51","guid":{"rendered":"http:\/\/www.kaufholdreveillaud.lu\/?p=2813"},"modified":"2023-11-14T17:20:34","modified_gmt":"2023-11-14T16:20:34","slug":"covid-19-chomage-partiel-aide-employeurs-1","status":"publish","type":"post","link":"https:\/\/www.kaufholdreveillaud.lu\/fr\/covid-19-chomage-partiel-aide-employeurs-1\/","title":{"rendered":"COVID-19 Le Ch\u00f4mage Partiel Aide : Les Employeurs (Part 1)"},"content":{"rendered":"<p>Consid\u00e9rant les r\u00e9percussions d\u00e9sastreuses des mesures prises dans la lutte contre le <a href=\"http:\/\/www.kaufholdreveillaud.lu\/index.php\/2020\/04\/22\/big-data-covid-19-remede-miracle-ou-poison-aux-effets-indesirables-liberticides\/\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19<\/a> pour l\u2019\u00e9conomie en g\u00e9n\u00e9rale et l\u2019emploi en particulier, le gouvernement a sp\u00e9cialement am\u00e9nag\u00e9 un m\u00e9canisme de soutien financier qui existait d\u00e9j\u00e0\u00a0: le ch\u00f4mage partiel.<\/p>\n<p>Tout en reconnaissant que la survenance du <a href=\"http:\/\/www.kaufholdreveillaud.lu\/index.php\/2020\/04\/28\/crise-de-covid-19-cui-bono\/\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19 constitue un cas de force majeure<\/a>, le gouvernement a en effet institu\u00e9 le r\u00e9gime du \u00ab\u00a0ch\u00f4mage partiel pour cas de force majeure li\u00e9e \u00e0 la crise du COVID-19\u00a0\u00bb.<\/p>\n<p>En vue d\u2019\u00e9viter des licenciements \u00e9conomiques en maintenant ainsi <a href=\"http:\/\/www.kaufholdreveillaud.lu\/index.php\/our-services\/labor-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">l\u2019emploi dans les entreprises<\/a>, ce m\u00e9canisme permet de fournir directement aux employeurs les liquidit\u00e9s n\u00e9cessaires afin de faire face \u00e0 des difficult\u00e9s de tr\u00e9sorerie pour payer leurs salari\u00e9s, puisque leur entreprise ne peut plus fonctionner normalement.<\/p>\n<p>Bien s\u00fbr, la dur\u00e9e de ce soutien financier restant limit\u00e9e, toute l\u2019ampleur des r\u00e9percussions \u00e9conomiques de la crise actuelle li\u00e9e \u00e0 la lutte contre le COVID-19 ne pourra \u00eatre mesur\u00e9e qu\u2019\u00e0 la sortie effective de cette crise.<\/p>\n<h2>Quels employeurs\u00a0?<\/h2>\n<p>Les employeurs de tous les secteurs de l\u2019\u00e9conomie peuvent se voir octroyer le b\u00e9n\u00e9fice du ch\u00f4mage partiel \u00e0 condition, bien \u00e9videmment, que les difficult\u00e9s \u00e9conomiques rencontr\u00e9es par eux soient directement en lien avec la crise li\u00e9e \u00e0 la lutte contre le COVID-19.<\/p>\n<p>Bien \u00e9videmment, une distinction parmi les employeurs s\u2019impose, alors que les mesures gouvernementales prises dans cette lutte ont contraint certains employeurs \u00e0 fermer leurs portes en arr\u00eatant temporairement leurs activit\u00e9s\u00a0:<\/p>\n<ul>\n<li>les employeurs susvis\u00e9s peuvent automatiquement b\u00e9n\u00e9ficier du ch\u00f4mage partiel et ce, \u00e0 partir de la date de prise d\u2019effet de la mesure gouvernementale en cause (le dossier sera imm\u00e9diatement trait\u00e9 par l\u2019ADEM pour paiement)\u00a0;<\/li>\n<li>les autres employeurs, qui continuent leurs activit\u00e9s dans la mesure du possible, verront leur demande d\u2019octroi du ch\u00f4mage partiel soumis \u00e0 l\u2019analyse de l\u2019autorit\u00e9 comp\u00e9tente, le Comit\u00e9 de conjoncture, qui d\u00e9cidera si, effectivement, l\u2019employeur peut en b\u00e9n\u00e9ficier (le dossier sera ensuite trait\u00e9 dans ce cas par l\u2019ADEM pour paiement)<\/li>\n<\/ul>\n<p>Il est \u00e0 noter que pour se voir octroyer le b\u00e9n\u00e9fice du ch\u00f4mage partiel, toutes les possibilit\u00e9s de maintien d\u2019un niveau normal de l\u2019emploi par les moyens propres de l\u2019entreprise doivent \u00eatre \u00e9puis\u00e9es. Il est ainsi exig\u00e9 notamment que les cong\u00e9s des ann\u00e9es 2019 et ant\u00e9rieures soient enti\u00e8rement pris par les salari\u00e9s concern\u00e9s. Cette exigence ne s\u2019applique pas pour les cong\u00e9s de l\u2019ann\u00e9e 2020, ni pour un compte \u00e9pargne-temps.<\/p>\n<p>Finalement, les employeurs, qui sont actuellement autoris\u00e9s \u00e0 reprendre l\u2019exercice de leurs activit\u00e9s, peuvent encore b\u00e9n\u00e9ficier du ch\u00f4mage partiel si la reprise normale de leurs activit\u00e9s n\u2019a pas pu se faire \u00e0 cause de la crise li\u00e9e au COVID-19 (par exemple, manque de marchandises).
