href=\"http:\/\/www.kaufholdreveillaud.lu\/index.php\/2020\/04\/07\/2-mesures-en-faveur-des-salaries-dans-la-lutte-contre-le-coronavirus-2-measures-for-employee-relief-during-the-coronavirus-fr-en\/\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19<\/a> et prot\u00e9ger les salari\u00e9s dits vuln\u00e9rables (les salari\u00e9s d\u2019un certain \u00e2ge, les salari\u00e9es enceintes, les salari\u00e9s d\u00e9j\u00e0 atteints de pathologies m\u00e9dicales etc.), une solution est disponible en faveur des employeurs\u00a0lorsque cela est envisageable : le t\u00e9l\u00e9travail permettant aux salari\u00e9s d\u2019ex\u00e9cuter leur travail \u00e0 partir de leur domicile.<\/p>\n<h2>Dans quel cadre\u00a0?<\/h2>\n<p>De fa\u00e7on g\u00e9n\u00e9rale et en tout temps, l\u2019employeur doit assurer la sant\u00e9 et la s\u00e9curit\u00e9 des salari\u00e9s sur leur lieu de travail et doit, \u00e0 ce titre, prendre toutes les mesures qui s\u2019imposent \u00e0 cet \u00e9gard.<\/p>\n<p>Dans le contexte actuel exceptionnel de lutte contre le COVID-19 et des recommandations gouvernementales visant \u00e0 favoriser le recours au t\u00e9l\u00e9travail, alors que la dur\u00e9e de cette mesure sera limit\u00e9e \u00e0 cette crise, l\u2019employeur peut imposer par pr\u00e9vention le t\u00e9l\u00e9travail \u00e0 ses salari\u00e9s lorsque leurs fonctions le permettent.<\/p>\n<p><em>A contrario<\/em>, l\u2019employeur n\u2019est pas oblig\u00e9 d\u2019accepter la demande d\u2019un salari\u00e9 qui, par seule crainte du COVID-19, souhaite t\u00e9l\u00e9travailler, N\u00e9anmoins, dans ce cas, au regard de l\u2019obligation g\u00e9n\u00e9rale susvis\u00e9e de l\u2019employeur envers ses salari\u00e9s, le refus oppos\u00e9 par l\u2019employeur doit \u00eatre n\u00e9cessairement justifi\u00e9 par les besoins de l\u2019entreprise.<\/p>\n<p>Rappelons que la mise en place du t\u00e9l\u00e9travail doit \u00eatre formalis\u00e9e entre l\u2019employeur et le salari\u00e9.<\/p>\n<p>En temps normal, cette formalisation sera r\u00e9alis\u00e9e par la conclusion d\u2019un avenant conclu entre le salari\u00e9 et l\u2019employeur ou par tout autre accord \u00e9crit, la d\u00e9l\u00e9gation du personnel (s\u2019il y en a) devant \u00eatre consult\u00e9e.<\/p>\n<p>Toutefois, la Chambre des salari\u00e9s rel\u00e8ve qu\u2019en raison des circonstances exceptionnelles actuelles, la mise en place du t\u00e9l\u00e9travail au sein de l\u2019entreprise n\u00e9cessite uniquement l\u2019accord de la d\u00e9l\u00e9gation du personnel (s\u2019il y en a), l\u2019employeur devant par la suite simplement notifier par \u00e9crit cette mise en place aux salari\u00e9s.<\/p>\n<p>Il est finalement certain que le salari\u00e9 devant travailler pour l\u2019employeur dans le cadre du t\u00e9l\u00e9travail, la r\u00e9mun\u00e9ration du salari\u00e9 restera \u00e0 charge de l\u2019employeur.<\/p>\n<h2>Mise en place et prise en charge des co\u00fbts\u00a0?<strong>\u00a0<\/strong><\/h2>\n<p>Pour permettre aux salari\u00e9s de t\u00e9l\u00e9travailler, l\u2019employeur doit leur fournir tous les moyens techniques pour ce faire (un ordinateur, un t\u00e9l\u00e9phone portable, une imprimante etc.), tout en assurant l\u2019installation et l\u2019entretien de ceux-ci, un appui technique devant rester \u00e0 disposition du salari\u00e9 en cas de besoin.<\/p>\n<p>Lorsque le salari\u00e9 utilise exceptionnellement son mat\u00e9riel personnel pour t\u00e9l\u00e9travailler, l\u2019employeur doit en assurer l\u2019entretien et l\u2019ad\u00e9quation au travail \u00e0 fournir, ainsi que l\u2019appui technique pr\u00e9cit\u00e9.<\/p>\n<p>Bien \u00e9videmment, en cas de dysfonctionnement ou panne de ces moyens techniques, le salari\u00e9 doit avertir imm\u00e9diatement l\u2019employeur qui doit alors intervenir promptement pour y rem\u00e9dier et permettre au salari\u00e9 de poursuivre son travail \u00e0 domicile.<\/p>\n<p>En tout \u00e9tat de cause, l\u2019employeur doit assumer les co\u00fbts li\u00e9s directement au t\u00e9l\u00e9travail (\u00e9lectricit\u00e9, connexion internet, usure du mat\u00e9riel informatique personnel du salari\u00e9 si tel est le cas, \u00e9ventuels achats par le salari\u00e9 d\u2019une imprimante et de recharges d\u2019encre etc.).<\/p>\n<p>Il est \u00e9galement important de relever que dans la mise en place du t\u00e9l\u00e9travail, l\u2019employeur doit pr\u00e9server la protection des donn\u00e9es \u00e0 caract\u00e8re personnel et le secret
