Le parent qui souhaite exercer son droit au deuxi\u00e8me cong\u00e9 parental, doit notifier sa demande \u00e0 son employeur, par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception, au moins quatre mois avant le d\u00e9but du cong\u00e9 parental (article L.234-46 (2) du Code du travail).<\/p>\n

Votre employeur n\u2019a pas le droit de vous notifier une convocation \u00e0 un entretien pr\u00e9alable (tel que pr\u00e9vu par l\u2019article L.124-2 du Code du travail) ou la r\u00e9siliation de votre contrat de travail, \u00e0 partir du dernier jour du d\u00e9lai pour le pr\u00e9avis de notification de la demande du cong\u00e9 parental et pendant toute la dur\u00e9e du cong\u00e9 (article L.234-47 (8) du Code du travail).
\nDans les quinze jours qui suivent le licenciement, vous pouvez demander au Pr\u00e9sident du tribunal du travail qui statue en urgence et comme en mati\u00e8re sommaire, de voir constater la nullit\u00e9 du licenciement et d\u2019ordonner le maintien de votre contrat de travail.<\/p>\n
