L&#8217;avertissement renforce la position de l&#8217;employeur.<\/p>\n<p>Le code du travail ne r\u00e9glemente pas les avertissements : ils ne sont donc soumis \u00e0 aucun formalisme particulier.<\/p>\n<p><strong>Notre conseil :<\/strong><\/p>\n<p><strong>Du c\u00f4t\u00e9 de l&#8217;employeur :<\/strong><\/p>\n<ul style=\"color: black;\">Notifier l&#8217;avertissement dans un d\u00e9lai raisonnable par lettre recommand\u00e9e ou remise en main propre contre signature en deux exemplaires (un pour l&#8217;employeur et un pour le travailleur) apr\u00e8s avoir pris connaissance de l&#8217;infraction pr\u00e9sum\u00e9e ;<\/p>\n<li>R\u00e9diger l&#8217;avertissement dans une langue comprise par le travailleur ;<\/li>\n<li>Mentionnez qu&#8217;il s&#8217;agit d&#8217;un avertissement ;<\/li>\n<li>Pr\u00e9ciser la faute exacte qui est all\u00e9gu\u00e9e ;<\/li>\n<li>Rappeler \u00e0 l&#8217;employ\u00e9 ses devoirs ;<\/li>\n<li>Indiquez les cons\u00e9quences pr\u00e9cises du grief all\u00e9gu\u00e9 (voire rappelez au salari\u00e9 les avertissements pr\u00e9c\u00e9dents s&#8217;il y en a).<\/li>\n<\/ul>\n<p><strong>Du c\u00f4t\u00e9 de l&#8217;employ\u00e9 :<\/strong><\/p>\n<ul style=\"color: black;\">\n<li>Il est recommand\u00e9 de contester l&#8217;avertissement par lettre recommand\u00e9e ;<\/li>\n<li>R\u00e9p\u00e9tez le ou les griefs point par point, en exposant les faits ;<\/li>\n<li>Indiquez que vous contestez formellement le(s) fait(s) qui vous est (sont) reproch\u00e9(s).<\/li>\n<\/ul>\n<p><span style=\"color: black;\"><br \/>\nLorsque le travailleur conteste la validit\u00e9 des avertissements, l&#8217;employeur doit fournir des preuves.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&#8217;avertissement est une r\u00e9primande de l&#8217;employeur \u00e0 l&#8217;\u00e9gard de l&#8217;employ\u00e9, un avertissement de l&#8217;employeur pour encourager l&#8217;employ\u00e9 \u00e0 changer de comportement.
